Andrew is member of Buddle Findlay’s resource management and local government teams. Andrew advises a range of clients, including developers, network utility operators, local authorities and financiers.
Andrew specialises in local government law, particularly decision- making, funding, regulation and associated areas (building, public works, official information).
Andrew has an in-depth insight into how local authorities work, having spent 3 years as an in-house secondee. In this role Andrew became the council’s primary in-house lawyer tasked with dispute resolution and providing advice on aspects such as voting, bylaw drafting, LGOIMA requests and code of conduct proceedings.
Andrew has also appeared successfully at all levels from local authority hearings to the Court of Appeal.
Recent work includes:
- Advising Rodney District Council on wastewater and water supply extensions at Te Hana, Warkworth and Kumeu/Huapai and negotiating associated agreements
- Obtaining wastewater and stormwater discharge consents in Snells Beach, Orewa and Whangaparaoa
- Advising various financial institutions on environmental aspects of loan arrangements, risk management and receiverships
- Successfully appealing Environment Court decision on the application of the Augier principle
- Successfully appealing Environment Court decisions in the High Court and Court of Appeal relating to the permitted baseline and existing use rights.
