We are experts on the Fair Trading Act and the Commerce Act. We have been involved in the design of New Zealand's competition/antitrust laws, worked for the competition regulator, and provided strategic advice on competition aspects of local and international clients' business operations.
We specialise in advising on competition implications of business acquisitions and arrangements (such as mergers, joint ventures, and franchise and reseller arrangements), including price fixing, resale price maintenance and market power issues. We review pricing, marketing and other business practices in terms of both the Commerce Act and the Fair Trading Act.
We have a strong track record in acting for clients in Commerce Commission investigations, including in relation to a number of cartel investigations, and in Commerce Act litigation.
We also act for clients in clearance and authorisation applications for business acquisitions and restrictive trade practices, and provide advice on industry-specific and generic regulatory control legislation, including price control and information disclosure, and assist clients dealing with government departments. We also regularly provide competition law compliance training to many of our clients.
Our clients include the Electricity Authority, Ministry of Primary Industries, SKY Network Television, Auckland Council, Zespri International, EnviroWaste, and Chevron.
"They've been wonderful – very quick to pick up on any concerns and very open in terms of giving us options to consider."
