Scott Barker, partner at Buddle Findlay was interviewed by the NBR. A New Zealand lawyer has been criticized by a UK judge for failing to administer a series of trusts in accordance with their governing deeds, leading to the conclusion that the trusts were shams. The solicitor was also criticised for misleading the court and giving evidence lacking candour in litigation involving those trusts.
"It is a serious statement to make against a legal professional" says Scott. "There is, in a very general sense, some precedent for the Law Society to take on this kind of action [investigating professional conduct issues on its own motion] even if the actions took place in the High Court in London."
