Auckland Transport
We are advising Auckland Transport on all aspects of its open-market tender for a long-term franchise contract for public transport rail services in Auckland.
A well developed, properly integrated and commercially robust public transport rail services system is central to the long-term prosperity and growth of the Auckland region. The appointment of an experienced rail franchise operator is fundamental to ensuring the continued growth and success of rail as a public transport mode in the Auckland region – particularly in a time of significant change to the Auckland rail network, notably the electrification of the network and the integration of the City Rail Link project.
We partnered with Auckland Transport on its open-market tender for a long-term public transport franchise contract. We worked collaboratively on this project, with Allens Linklaters, Melbourne, who provided 'best-in-class' international experience. Together, we advised on all aspects of the procurement process including:
- The detailed policy design of the commercial construct (including the pricing model) and allocation of risks, roles and responsibilities
- The contractual matrix for the project (based on the project's commercial and operating model and support development of a contract management manual)
The rail services franchise agreement and all related transaction documents and supporting the development of the tender documents, including a competitive BAFO process.
